After this, on 8th February, 2012 at about Twelve 'o' clock I have received a phone call from O.S.D. It was requested through that call to stop the instant agitation programme slated to be held on 8th Feb. and Mem(P&V) shall meet the Association representatives on 10th February at 12.00 'o' clock. The faxed letter is reproduced below:

We have discussed about all the points covered in our letter for appointment, In the meeting apartfrom Mem(P&V), J.S.(ADMN.), DG HRD & ADG HRM , Director AD-IIA, Deputy Secretary AD-IIIB were also present. From the Association Secretary General, Joint Secretary North( Sri Abhay Singh), Organising Secretary ( Jitedra Saini) attended the meeting

For CR it was replied that the file has been sent back to DOP&T
for removal of stagnation & regional disparity it was understood that Board is yet to arrive at a solution,
Succumbing to our pressure Director AD-IIA forwarded the file on the subject matter of 'Juniors drawing more pay than their Seniors' to Mem(P&V) through J.S.(Admn); and member(P&V) assured the delegation that the notification would be issued by next week.
On ICT it appeared that Board is quite rigid on this point that the relaxation of probationary period could not be granted to officers who has not completed it, JS(Admn) opined that relaxation if possible could be granted to all, Member assured us that the issue would once again be discussed in the full Board meeting.

The resolution adopted in the meeting of JAC in CBEC at New Delhi on 09.02.2012 is appended below, this resolution was submitted to every formation inclusive of Cabinet Secretary and addressed to Finance Minister:

Joint Action Committee in CBEC met in New Delhi on 09.02.2012

Joint Action Committee in Central Board of Excise & Customs consisting of Group ‘C’, Group’D’ organizations in Central Excise & Customs and All India Central Excise Inspectors Associations met in New Delhi on 9^th February, 2012. Central Excise Superintendents’ Association was also invited for this meeting due to time constraint they could not attend it.

The meeting was presided over by .Mr. Gaikwad from Central Excise and Sri B.D.Survey from Customs. It was unanimously decided that Board and the different formations of Government of India has to complete the Cadre restructuring process immediately taking in to account the submission made by the Joint Action Committee in CBEC on 25.01.2011; the meeting observed that the CBEC has not yet bothered to call Joint Action Committee after a lapse of one complete year.

Hence, it was unanimously decided that All the organizations shall BOYCOTT Central Excise day Celebration on 24^th of February, 2012. The next course of action would be as follows:

1) 16^th March 2012 mass walk out from 14.00 hours to 16.00 hours

2) 23^rd March 2012 mass walk out from 14.00 hours to 18.00 hours

3) 30^th March 2012 Sign and walk out

All the leaders shall gather at New Delhi on 4^th of April, 2012 to take a stock of the situation and to formulate next course of action.

Dear Comrades,

As you are aware, the Central Executive Committee Meeting of the AICEIA held at Hyderabad on 27^th and 28^th of January, 2012. We thankfully appreciate the effort taken by the Hyderabad Branch for materializing the dream of our Association to conduct an All India Meeting in the first techno-city of India.

2. In the inaugural ceremony of the Meeting Shri. Asaduddin Owaisi,MP was the Chief Guest. Chief Commissioner(HZ) Shri.S.B.Singh was the Guest of Honour and special invitees were Commissioners Shri.P.N.Rao, Hyderabad-II, Shri.Ashok, Hyderabad III and Shri.G.V.Krishna Rao, Hyderabad IV. Shri.V.Nageshwar Rao, General Secretary, Confederation of Central Government Employees and Workers, Andhra Pradesh, Shri.Kousik Roy, Secretary General and Shri.K.P.Mano, President were also felicitated. Shri.B.Vijaya Bhaskar Reddy, General Secretary, Supdts’. Association, Shri.B.L.N.Varma, President of Hyderabad Branch of the AICEIA, Shri. K.Mahesh Raj, General Secretary of SC/ST Associaiton, Shri.B.BabuRao, President of Group-D Association and Shri.Samdhani Khan of Group-C Association were also present. Shri Arun Zacharia former President of the AICEIA was also invited in the as special guest. Shri.B.P.K.Reddy, All India Vice-President and the General Secretary of the Hyderabad Branch of AICEIA and his committee was very active and receptive of the entire meeting, right from the receipt of delegates.

3. Presidential award winners Shri Sridev Kumar, Supdt, Shri.SubbaRao, Inspector and Smt. Jayalaxmi Inspector were also felicitated on the occasion. In his brief speech Shri.V.Nageshwar Rao mentioned about the various achievements of Confederation and the recent achievement on the increment for all those who have joined during February to June before 01.01.2006. He requested the CEC to take positive approach towards the general strike called for 28.2.2012.

4. The Secretary General & President of the AICEIA mentioned about various pending issues that have not yet resolved due to the lack of positive approach from the DOP&T & Expenditure. They further sought the co-operation of the Hon’ble MP to settle the genuine problems faced by the cadre. It was brought to light that in spite of helpful approach from the Finance Minister a few burning issues are yet to be resolved due to bureaucratic hurdles.

5. In his return speech, Janab Barrister Asaduddin Owaisi, Hon’ble MP from Hyderabad promised all support and even to lead a delegation comprising AICEIA leaders during the ensuing Budget session of Parliament to the Hon’ble Finance Minister and even to the Hon’ble Prime Minister of India, with an eye to resolve all the pending issues. He advised the gathering not to forget the inner strength of an organisation which is always powerful.

6. In the closed session 63 delegates from 29 units attended the meeting and participated in the deliberations. It was resolved that the All India Association shall start its organizational action programme from 2^nd February 2012 wherever possible and in the whole of this country from 8^th of February 2012on the following agenda:

Minimum fixation after correction of Grade pay from Rs. 4200/- to Rs. 4600/- should be implemented forthwith.
Clarifications on the Inter Commissionerate transfer as requested by the association should be issued immediately.
Implementation of Judgment dt.17.1.2012 of the CAT Bombay Bench for notional fixation of revised pay scale from 01.01.1996.
To resolve the ratio issue for promotion to the grade of Assistant Commissioner.
PFRDA bill should be scrapped and all possible help to the working classes organisation would be initiated for this.
Inspectors of 2002 batch should be promoted in this restructuring across the country.
Base cadre seniority to be taken as the criteria for the promotions to Gr.A posts in the CBEC.
Regional disparities in the grade of Inspector to Superintendent promotion should be wiped off in the ensuing cadre restructuring.
Superintendent’s grade pay should start from 5400/- grade pay.
All vacancies in the Inspector grade should be filled up immediately.

7. Further, following important decisions have also been taken in the meeting:

A case for relief on the lines of ITGOA would be filed at CAT Bombay, Bench on the notional fixation issue wef 1.1.1996. AICEIA Joint Secretary, Shri.Sanjay Srinivasan would take lead for the same.
Shri.B.P.K.Reddy, AICEIA Vice-President to take lead and to form a platform at yderHyderabad to discuss the early implementation of CAT Judgment dated 17.1.2012 with all affected Associations in CBDT and CBEC.
All Branch/Circle level elections would be on par with the All India Constitution.
To demand all India seniority of Inspectors since 2004 to address the issues of Inspectors who are recruited based on an all India rank-list.
A five member Committee consisting of President, Working-President, Secretary General, Assistant Secretary General & Liason Secretary has been formed in order to redraft the present Constitution of the Association.
AICEIA shall participate in the All India Strike call given by the Steering committee of Central and State government Workers on 28^th February 2012 on the following agenda:

ü No contractorisation of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the Industry/establishment.

ü Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at

ü not less than Rs 10,000/-.

ü Remove the ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.

ü Assured Pension for all. Scrap PFRDA bill, reintroduce pension and provident fund for all those who have joined after 01.01.2004.

ü Enhance interest rate on G.P.F immediately.

ü Merge 50% D.A. with Pay Band and announce next Pay Commission.

ü Compulsory registration of trade unions within a period of 45 days and immediate ratification of ILO conventions 67 and 96.

8. It is a welcome note that the AICEIA Mumbai Circle has returned to the fold of AICEIA and participated actively in the CEC meeting. The President commended the proceedings with regard to the positive attitude of the delegates and observance of punctuality and urged the delegates to fondly remember the efforts of former leaders of the association. The Assistant SG Shri.Ajit.K.G. proposed vote of thanks.

9. AICEIA office bearers shall participate in the meeting of the Joint Action Committee of the Associations in C.B.E.C on 9^th February, 2012 at New Delhi and further action programme would be intimated after the meeting of the JAC.

Inaugural Ceremony of the CEC Meeting at Hyderabad went off with a flying start. It was a colourful event with every thing being conducted professionally and successfully.

BANGALORE: Assuring officers of the Indian Revenue Service that their long standing demand for Cadre Review, V Narayanasamy, Union Minister of State for DoPT, PMO and Parliament Affairs on Friday said, “Within a fortnight cadre review will be finalised with the PMO’s approval. The government will safeguard your interests.” He was addressing the inaugural session of the All India Convention of the Indian Revenue Service Association.
Placing the blame for the inordinate delay in cadre review on the association, Narayanasamy said that the association must take the initiative and put pressure on the government. “For 10 years no initiative was taken. The fault is in your part,” he said. Praising the service, he went on to add that the Food Security Bill would require expenses of `86,000 crore and these were calculated by the government based on generation by the IRS. The service, so far has seen only four cadre reviews between 1975 to 2000 and DoPT guidelines state that cadre review is a must every five years. He said that in HAG+ category where the second category had to report to the first, the government is working out a system where seniority will be maintained. “Middle-level officers will be given more than what you asked for. I will be meeting Finance Secretary and chairman of CBDT next week to finalise additional posts for middle-level,” he said. He also announced that the CBDT chairman would now have a fixed tenure instead of a period of three months which will allow the incumbent to focus on major issues like pay scales and cadre reviews. In a lighter vein, the minister also said that IRS would have to look at increasing its expected collection from Rs 5,32,000 crore to Rs 6,00,000 crore after the cadre review decisions were made.

UPDATE ON SOME IMPORTANT ISSUES:

Recently S.G and President paid a visit to North Block and other important offices of New Delhi.

After several discussion with various officials viz: Chairman, Member(P&V), J.S.(Admn.) of C.B.E.C & Additional Secretary D.O.P&T , D.G. & A.D.G (H.R.D & H.R.M) we would like to place the following statement for information of our members:

Restructuring file has not yet sent back to our Board,
Several rounds of discussion going on amongst D.O.P&T, C.B.E.C and Deptt of Revenue.
As assured by HRM the file would come back to C.B.E.C for finalization of cabinet note by the end of this month.
There is a fair chance of reduction of Gr. ‘A’ post as D.O.P&T deals with right sizing of Gr. ‘A’ strength in a restructuring of a particular department.
Reduction of Gr.’B’ post from the proposed strength was ruled out by the above officials.

On the serious issue of Senior drawing less pay than Juniors the following steps have been taken recently::

After a hell bent discussion with Director D.O.P&T sent it back to Expenditure
Had meeting with director D.O.P&T & Director (EIII) along with Under Secretary ( EIIIA) Expenditure and successfully convinced them to delink the two pending issues and to instruct department of Revenue and C.B.E.C to issue order for fixation of seniors drawing less pay than juniors in relation to pay of Rs, 17,140 of Direct recruits from 01.01.2006.
The other part in relation to fixation of pay on par with pre-revised payscale of Rs. 7450/- has become a general issue and D.O.P&T instructed the Expenditure Ministry to take its decision taking in to consideration its ramification on national exchequer and Government.
Though Expenditure appears to be not very keen in granting the required fixation of pay on par with pre-revised payscale of Rs. 7450/-, yet, we are hopeful as almost all departments inclusive of C.B.D.T have initiated their representation on this issue.

On the issue of ICT it was intimated to Board officials that Chief Commissioners of different field formations are fixing their own criteria in granting I.C.T and it is learnt that depending upon the representation of our Association, the point in relation to abolition of the term ‘probationary period’ is under strong consideration of board along with various other points on this issue.

Dear Comrades,

Wish you a happy and prosperous new year 2012.

As you are aware, the 1^st CEC of the AICEIA after the 16^th Convention is going to be held at Hyderabad on 27^th and 28^th of January, 2012. I appreciate the initiative taken by our Hyderabad Branch for hosting an all India Meeting.

In our previous all India meetings we have decided to resolve various issues and before the commencement of next meeting also we hope to do as much as possible. XVI Convention at Bengaluru also proved to be successful on that count. The following important issues were proved to be successful on which we also placed our hands during last six months:

· To resolve the ratio issue for promotion to the grade of Assistant Commissioner;

· Inter Commissionerate transfer;

· PFRDA bill

We know that our members have their valuable opinion in this regard. Hence we invite detailed discussion and like to chalk out probable resolvable correction on these issues after taking it threadbare in the Unit/Branch/Circle level. You all are aware of the fact that AICEIA supported and participated in the Parliament rally held on 25.11.2011 and subsequently it was found that that the PFRDA bill could not be tabled in the Parliament succumbing to the protest from the working class.

We invite your esteemed opinion on the following issues too:

1. Minimum fixation after correction of GP from Rs. 4200/- to Rs. 4600/- should be implemented forthwith.

2. Inspectors up to 2002 batch should be promoted in this restructuring throughout India.

3. Demand for taking base-cadre seniority for promotions to Gr.A to bring parity with analogous cadres.

4. Regional disparities for promotions in the grade of Inspector to Superintendent should be wiped off.

5. Superintendents’ GP should be made Rs.5,400/-.

6. Anomally in the case of MACP after the GP of Rs.5,400/-.

7. All India Strike call given by the Steering committee of Central and State government Workers on 28^th February 2011 on the following agenda:

· No Contractorisatlon of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the Industry/establishment.

· Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at

not less than Rs.10,000/-.

In the meantime we are to inform you that the Government has today agreed in the Anomaly Committee meeting to grant one increment on 1.1.2006 in the pre-revided scale of pay for all those whose increment falls between 1^st Feb and 30^th June 2006. This is applicable only for those who were in service as on 1.1.2006. They will draw their next increment in the new Pay Band on 1^st July 2006.

I thank all comrades of the West Bengal, Sikkim & Andaman & Nicobar Circle of the AICEIA for giving me an opportunity or rather a privilege, to participate in their 3^rd conference on 21^st and 22^nd of December at Kolkata. It was a truly enriching experience for me. The democratic, participative and inclusive manner in which the Association activities are conducted there truly set benchmarks for the other Circles and units to follow. While the conduct, all-round contribution, and leadership of All India Office bearers of the Association hailing from WB, and equally that of the delegates from that Circle, in CEC’s and Conventions at the national level are always impressive and well known all across the country, the enthusiasm and dedication I witnessed over the past two days in a State/Circle level Conference has left me spellbound- I am truly amazed at the vibrant and robust organization of the Circle.

My congratulations to all members of the Circle for the successful conducting of the Conference, and I extend my warmest Fraternal Greetings to all of you once again and my Best Wishes to the newly elected Office Bearers of the Circle. Especially worth mentioning is the fact that even the junior-most and youngest Inspectors participate with such enthusiasm, standing shoulder to shoulder with seasoned veterans of many a campaign – what a wonderful sight it was. The President of the AICEIA attended the National Council Meeting of the Confederation of CG Employees & Workers held at Cochin on 16.12.2011 which was inaugurated by Com.P.Rajeev, Hon’ble M.P., Rajya Sabha. Com.K.K.N.Kutty, Secretary General submitted the report narrating the activities of the confederation and the national and International developments of the last one year. 14 point charter of demands was presented and the meeting gave a go-ahead for the proposed general strike on 28.2.2012. The charter includes the call for scrapping of new pension scheme, revision of GPF interest rates, OTA etc. and merger of DA with Pay. Our President during his speech assured all co-operations for the activities of the Confederation being an affiliate, but cautioned against the date of proposed strike as the same falls probably on the pre-Budget day. Confederation SG would be attending the National anomalies committee meeting for the VI CPC to be held at New Delhi on 5.1.2012 wherein it is expected to clear the increment issue of those drawing during the months of February to June.

Government bent down partially under the pressure of the working classes movement

The Central Government had introduced the New Pension System (NPS) with effect from January 1, 2004 (except for armed forces) for its employees.

In respect of Central Government employees who have joined in Government Service on or after 1.1.2004, this scheme is mandatory.

Pension Fund Regulatory and Development Authority (PFRDA), is the interim regulatory body for NPS which was established by Government of India on 23rd August 2003.

In NPS, a government employee who is covered under NPS contributes 10% of his/her salary towards pension along with matching contribution from the employer.

While contributions in NPS are collected from Central Government Employees since 1.1.2004, the pension contributions of Central Government employees have been handed over to Pension fund Managers viz, LIC Pension Fund Limited, SBI Pension Funds Pvt. Limited and UTI Retirement Solutions Limited in a predefined proportion, only from 1st April 2008.

Now, the Minister of State for Finance, Shri Namo Narain Meena in written reply to an Un-starred Question in Lok Sabha on 16.12.2011, stated that the institutional architecture for NPS could not be operationalised by the Interim Pension Fund Regulatory and Development Authority (PFRDA), for the period from 1.1.2004 to 31.03.2008 and therefore, the contribution for the Government employees under the NPS during this period could not be invested in the market.

A total amount of Rs. 971.48 crore, collected towards contribution for Government employees, from 2004 to March 2008, under the New Pension System (NPS), was credited to the Public Account of India. The funds credited to Public Account will carry an interest @ 8% p.a.

PFRDA Bill, 2011 which would give official status to PFRDA has already been approved by Cabinet and placed before Parliament. However, the same is yet to be passed in the parliament for enactment.

DEVELOPMENTS

Secretary General and Vice President (North) persuaded the three following issues in New Delhi:

· Anomaly of senior drawing less pay than juniors arising out of fixation of pay after revision of grade pay from 4200/- to 4600/-,

· Progress of Cadre Review,

· Renewal of recognition.

The first point was discussed with different Board officials, Expenditure Ministry & Dy. Secy. D.O.P&T; it was understood that the first part in relation to senior drawing less pay than juniors arising out of fixation of pay after revision of grade pay from 4200/- to 4600/- is fixed now and for the manner of fixation part i.e. grant of one additional increment to all those Inspectors who got promotions or recruited before 01.01.2006, Expenditure referred the file to D. O. P. & T. Board could not issue the order as the two issues are processed through a single note. It was assured to us that the Board would be issuing the letter immediately after getting the file from D.O.P&T. Hence the confusion regarding fixation of pay at the minimum of 17140/- is cleared and would be effected shortly.

The delegation met Joint Secy. (D.O.P&T) Sh. Rajeev Kapoor & different officials inclusive of Sh. Anant Kumar to get a clear Idea about the proposal and progress. It was understood that the file is with Deputy Secretary (D.O.P&T), they are examining the CR proposal especially for HAG scale; it was further intimated to the delegation that D.O.P&T is not only sympathetic but also trying to find out some solution on the acute stagnation of Inspectors & Superintendents. Till now there was no trace of curtailment of A.C. posts, discussions are on regarding one time relaxation for filling up of the posts arising out of CR through promotions only. It was assured to us that D.O.P&T shall complete its scrutiny within a fortnight from now and shall send it to Cadre Review Group within the DOPT. Once it was accepted by Cadre Review Group the rest is the implementation part.

Except Mumbai we have received DDO certificates from almost all parts of this country, in Mumbai at least more than 1100 members are deducting membership fees from salary for lack of supervision these DDO certificates and the contributions are not reaching to the Association. Members of Mumbai are requested to deposit the cheque in the Association Bank Account available in this blog. Once again we are able to submit more than 35% DDO certificates to Board for renewal of recognition. All the units are once again requested to submit their All India contribution forthwith as Association is struggling with lack of fund.

A meeting of the Associations was held on 29th November 2011 with the JS of DOP&T(Mr. Rajeev Kapoor). It was informed to the Associations that D.O.P&T would be taking its final decision on cadre restructuring very soon. It was understood that D.O.P&T has some reservation on the temporary approval of a section of the promotional posts .
D.O.P&T further informed the delegation that the stagnation of Inspector & Superintendent in Central Excise has already been pointed out and it was intimated that they are trying to find out a tangible solution to do away with this discrimination In CBEC and a meeting with CBEC and D.O.P&T is well expected within the next week.

Latest Developments

The file dealing with Restructuring of CBEC is back in the DoP&T, and it is with the Secretary now. It is also learnt that the Board has not made any significant changes in the original proposal, and even after 4 rounds of queries and corresponding responses and justifications, the proposal retains its original shape. The CBDT proposal has reportedly gone past DoP&T, and it is understood that both proposals will be presented before the Committee of Secretaries together sometime next month. Methods to do away with regional disparities while allocating posts arising out of cadre restructuring are also being devised by the DGHRD.

Since the Board’s communication lifting the ban on ICT has thrown up some confusion, and has stipulated some avoidable preconditions, the AICEIA has written to the Chairman, Member(P&V), JS(Admin) requesting for clarifications/amendments in the same. The matter has further been taken up with senior officials of the Board concerned with the matter, and should get resolved soon. Our letter is appended below.

On the stepping up issue of seniors drawing less pay than junior inspectors who joined the deptt. after 1.1.2006, CBEC has sent the draft clarification to be issued for the DoP&T’s concurrence, as required by Deptt. of Expenditure, to whom the original reference was made by the Board. We have pursued the issue vigourously all along, and continue to do so, and the file has now moved from the concerned Section upward, and it is expected that we will get the desired results within a fortnight.

On 25.11.2011, a March to Parliament was organised as part of the ongoing movement against the PFRDA Bill, with thousands of Central and State Govt. employees gathering at Delhi to make their collective voice heard against the said Bill. In response to the call made by the Confederation of Central Govt. Employees and Workers to participate in the same, President and Asstt Secy. General of the AICEIA along with some of our members attended the protest at Delhi.

The AICEIA will be shortly taking up with the Board the issue of extending benefit of stepping up of pay to all senior inspectors who , having been promoted from the ministerial cadre, are drawing lesser pay than their juniors who have got the benefit of ACP/MACP, following the Supreme Court’s dismissal of the SLP filed by the UOI in the case challenging the High Court of Punjab and Haryana’s verdict is under preparation, and suggestions may please be e-mailed to the Association at the earliest.

Subject: Lifting of ban on ICT.

Kind attention is invited to the letter F.No.A22015/23/2011-Ad.III.A dt.27.10.2011 lifting the ban on Inter Commissionerate Transfer which was in vogue since 19.2.2004. The Association takes this opportunity to express our gratitude for reinstating the ICT as it goes a long way to ease the difficulties faced by our member who are away from their home. However, in order to make the ICT more convenient and effective, it is requested that the following points may please be considered:

i) The Board’s above letter 27.10.2011, says that any willing Group B, C employee and the erstwhile Gr.D employee may apply for transfer from the jurisdiction of one CCA to another CCA subject to availability of vacancy. As the Group B officers include Gr.B Gazetted officers also, a clarification needs to be issued stating that only Gr.B non-gazetted officers are covered by the ICT, lest this may be erroneously interpreted in some corners for granting ICT to Superintendents and thereby adversely affecting the promotional avenues of the Inspectors of various zones. We also wish to point out that there is no provision for ICT in the Recruitment Rule for Superintendents similar to that available in other cadres having a DR element of appointment.

ii) The para 2(v) of the letter says that the request for ICT should not be entertained till the officer appointed completes the proscribed probation period. As, such a condition was not there in the Board’s letter F.No.A22015/19/2006-Ad.III.A dt.27.3.2009 under which the transfers have been allowed on the basis of employment of the spouse, it is requested that the same principle may be applied in the present case also and the condition of probation may not be insisted

in cases where transfers are allowed on spouse grounds. It may be recalled that a residency period was not prescribed in the circular dt. 20.05.1980 which laid down the comprehensive guidelines for ICT in CBEC.

iii) The para 2(vii) of the letter says that the officers who are presently working on deputation basis should revert back to their parent Commissionerate and then apply fresh for ICT. This creates avoidable difficulties for the members who are working at faraway places on deputation and does not appear to be fair when the Board allows the benefit of seniority based on the date of deputation to the category of officers who have been under deputation and subsequently absorbed between 19.2.2004 and 27.10.2011. This Association therefore request you to suitably amend this portion of the para as under:

2(vii) Officers who are presently working on deputation basis from their parent Commissionerate to any other Commissionerate /Directorate and are willing to get absorbed on ICT will have to make fresh representations to both their CCAs without reverting to their parent Commissionerate, and after getting approval from both the CCAs, the seniority may be fixed under the new CCA on the basis of the date of order of the ICT.

Central Government employees across the country ikely to join the historical parliament Rally on 25th of November 2011 against PFRDA bill. In response to this noble cause AICEIA decided to join this movement, members and leaders across the country requested to join the rally with full strength. Our All India President and Assistant Scretary General shall lead the rally.
The file containing junior drawing more pay than seniors after the revision of Gradepay from Rs. 4200/- to Rs. 4600/- is like ly to come back to Board's office within a short while, the office bearers would be persuing the issue while in Delhi. It has to be make clear that we have demanded an Extra increment for the people who have joined/ promoted before 01.01.2006 as Inspector, that is a reason for delay. The fixation of Rs. 17140/- that we can avail of at any point of time, in fact, Govt. is bound to provide us minimum fixation of Rs. 17140/-, but if we continue to avoid the basic demand of providing another increment to seniors then we may not raise this issue in future.

We invite your kind attention to the declaration adopted by the National Convention held at Mavalankar hall, New Delhi on 7^th September, 2011 in which delegates of all Central Trade Unions and Federations participated. (Copy appended hereunder for ready reference.) As you are aware, despite the protest and resistance movement organised by the working class, the UPA II Govt. had continued with the neo liberal policies unabated. The prices of all commodities especially the food articles had been constantly increasing and the Oil companies were permitted to increase the price of petroleum prices often. During its regime, the Govt. permitted the Oil companies to raise the prices of Petrol sixteen times and the Prime Minister has now threatened that his Govt. would soon take the decision to deregulate the administrative price mechanism in respect of cooking gas, kerosene and diesel very soon. For him the inclusive growth is only a phrase to be used to garner votes. In so far as the government employees are concerned, the next session of the Parliament would be crucial in as much as the Govt. Is bent upon enacting the PFRDA Bill to ensure the privatisation of Pension funds.

Even though the struggles against the Neo liberal policies were launched initially by the Left Trade Union and Left parties, the experience of the workers in the last ten years has compelled all Trade Unions to be part and parcel of the struggle against these policies. Whereas INTUC became the partners in the common struggles last year, the BMS has decided to join the common platform now. The Delhi Convention of 7^thSeptember, 2011 has called upon the workers to organise a Jail Bharo agitation on 8^th November,2011. We do appreciate the constraints of the Government employees to court arrest. But that should not deter us from ensuring the active participation of our rank and file members in this historic struggle. The State Committees and affiliates must make all efforts to enlist participation of large number of our members in the rally on 8^th November, 2011 at all places.

DECLARATION

The National Convention of Workers being held on 7th September 2011 at Mavalanker Hall, New Delhi noted with serious concern that despite several rounds of all in united protests by the entire trade union movement of the country, the Govt has remained totally unresponsive to major concerns of the working people.

Practically no step has been taken by the Govt to address the basic demands of the workers being pressed through joint memorandum by the Central Trade Unions to honourable Prime Minister and the Lok Sabha Speaker and various other joint countrywide programmes.

Rather, aggressive moves are being taken to further aggravate the rise in prices through frequent hike in prices of petrol, diesel, LPG and kerosene. Disinvestment of shares of Public Sector Units is being actively pushed through by the Govt to facilitate phased privatisation of the highly profit-making PSUs. Existing labour rights including right to form union and to social security and pension are being sought to be curbed through various legislative and administrative moves. Mass scale contractorisation of the regular work is continuing in all the workplaces including in PSUs and Govt. establishments. Contract workers are not being paid in most of the places even the statutory minimum wages which is very low to meet the basic requirements for a human living .

The National Convention also expresses its serious concern over the flaring up of rampant corruption all around and huge black-money-generation in the economy and seeks to draw the attention of the Govt to the widespread popular discontent and disgust over the issue of corruption demanding concrete legislative and administrative measures and change in the economic policy regime to eradicate and prevent corruption and bring back the black money stashed abroad.

The National Convention calls upon the working people of the country to further widen the unity achieved through united struggle and launch united protest against the unresponsive approach of the Govt through intensified countrywide struggles.

While reiterating the five point demands formulated jointly by the Central Trade Unions and Federations for

1) Concrete measures to contain price rise,

2) Concrete measures for linkage of employment protection with the concession/incentive package offered to the entrepreneurs,

3) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws,

4) Universal social security cover for the unorganized sector workers without any restriction and creation of a National Social Security Fund with adequate resources in line with the recommendation of NCEUS and Parliamentary Standing Committee on Labour and

5) Stoppage of disinvestment in central and state PSUs.

The National Convention of Workers also demands immediate action by the Govt of India to ensure:

• No Contractorisation of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the industry/ establishment

• Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs 10,000/-. • Remove all ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.

• Assured Pension for all

• Compulsory registration of trade unions within a period of 45 days and immediate ratification of the ILO Conventions nos 87 and 98

To press the above demands and to prepare for higher level of united action, the National Convention decides to hold Countrywide multiple forms of action such as SATYAGRAHA/JAIL BHARO, MASS SQUATTING etc. in all the state capitals and industrial centres on 8th NOVEMBER 2011.

The National Convention also calls upon all the trade unions and workers and employees in general irrespective of affiliations to hold statewise and industrywise conventions to make the above programme a total success and prepare for countrywide General Strike as early as possible in the next phase

JS(D.O.P&T) completed his presentation on 25.10.11. We have learnt that DOPT perhaps has asked CBEC to give permanent functional justification of promotional posts of AC+DC approved by Expenditure (temporarily). D.O.P&T raised its query on the issue of review of promotional quota after every 5 years. Further it is gathered that Board is all set to answer these questions. It is expected that the issue would be resolved amicably within the stipulated time frame.

The file containing removal of anomaly on the issue of juniors drawing more pay than seniors has gone past expenditure.

on 19th October AICEIA had a serious discussion with Secretary General of Superintendent's Association on the rectification of pay scale and its arrears issue, At the outset the demand for notional effect from 01.01.1996 was ruled out by Superintendents' Association; AICEIA tried to convince them that to bring all the organisations of Revenue Department together we should remain flexible . When Superintendent Association under the leadership of Ravi Malik expressed their inability to change the issue from 01.01.1986 to 01.01.1996 then AICEIA asked them about joint agitation programme to the tune of Strike action.It was narrated to the Superintendents that AICEIA has already made some VVIP references sucessfully, the need of the our is to take some programme and a joint representation to F.M. in this regard. Though arrear from 01.01.1186 is not achievable yet, for the dream of togetherness and to transform the agitation in a sucessful negotiation AICEIA was agreed to the proposal. AICEIA is all set to go for any kind of agitation to the extent of Strike if Superintendents' Association is able to take a strong stand. We hope your sensible comment shall enlighten the wise leadership of this Cadre ( INspector & Superintendent). Till date no positive reply has been received. All are requested to pursue the matter with Superintendents' Association wherever possible. At this point of time no court case no VVIP reference could help us except a vigorous organisational action programme . Any suggestion in this regard is deeply solicited.

Sub: amendments proposed in the Customs & Central Excise Group A Services Recruitment Rules… comments regarding

Reference is invited to the amendments proposed in the Customs & Central Excise Group A Services Recruitment Rules proposed by the Board. We would like to express our following reservations/suggestions in this regard.

The amendment proposes to revise the ratio of promotion to Grade VI of the service to 13:1:2. While welcoming the change, we wish to point out that unless the ratio is converted into a quota as in a post based roster, a drastic reduction in the representation of officers from the Central Excise stream would ensue, owing to the fact that a Central Excise promotee, in most cases retires within one to two years of induction in to the Group A service and the vacancies would be apportioned to other cadres also. Bringing in such a mechanism is imperative to give effect to the direction of the Apex Court that proportionate ‘representation’ for the three streams is to be ensured.
The march over done by the Customs streams over the years due to the unfair advantage in ratio has created large scale disparities in the matter of promotion of Central Excise Officers vis-à-vis Customs. As a measure to bring in some sort of parity, at the time of implementation of cadre restructuring, the vacancies in the grade of Assistant Commissioners should be filled up by length of Service in Group B by relaxing the provisions of Rule 18, in exercise of the powers under Rule 34.
The percentage of Direct Recruitment in Group ‘A’ should be reduced to 25% as in the case of Indian Postal Service in order to give more promotional opportunities from Group-‘B’ to Group ‘A’ cadre. It may please be recalled that during the 18^th January 2011 meeting called by the Chairman for consulting with the Associations on Cadre Restructuring, on this particular demand it was assured that it would be considered separately by delinking from cadre restructuring. Though it was not included in the Draft RR, we hope that this issue will be resolved while finalising the RR s.

The proposal to reduce the qualifying service for promotion to Group A to 2 years citing the DOPT circular dated 25.05.98 is detrimental to the cadre since it would only widen the disparity in promotion vis-à-vis the Appraisers. It may please be appreciated that the intent of the circular is only to fix the minimum service to move from one scale to another and it is not a fetter on the department to fix a realistic residency period taking into consideration various factors prevailing in the department.

5. The Grade V service may be made a non-functional one without linking it to vacancies as is in the case of Grade IV and III and the vacancies in both the grades should be taken together for the purpose of promotion.
